New Guidelines for Independent Contractors and Worker’s Compensation Insurance

The VT Department of Labor has released new guidelines concerning independent contractors and workers’ compensation insurance. The new guidance states that an employer cannot be assessed workers’ compensation premiums or found to be liable under the workers’ compensation code for workplace injuries incurred by an independent contractor if:

  • The contractor is registered with the Secretary of State as an LLC or corporate owner.
    The contractor has filed and received approval from the Department of Labor to opt out of worker’s compensation coverage.
  • The employer also is not liable if the contractor has its own insurance. .
